EVIDENCE:

Following the running of Race 1 Stipendiary Steward, Mr Shane Renault produced an Information alleging a breach of the programming conditions by Trainer Mr Gavin Smith. The detail of the Information was that Mr Smith was late to present ADITI on course at the required time before its race.

The Respondent Mr Smith signed the Information ” I do not wish to be present at the hearing of this Information” and stated he thought the first race had a start time of 3.30 pm.

The official start time was 3.11 pm

Mr Renault stated Mr Smith had breached the Rule early in November last year and although just inside the reset period, would consider a fine of $100 to be appropriate.

DECISION:

As the Respondent Mr Smith admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

REASONS FOR PENALTY:

Mr Smith has accepted his late arrival on the course has breached the Regulations and the Adjudicative Committee determined there were no compelling reasons to deviate from the Steward’s recommendation of a $100 fine as an appropriate Penalty in this case.

CONCLUSION:

The Respondent Mr Gavin Smith is fined $100.
