SUMMARY OF FACTS:

At the conclusion of Race 1 the PGG Wrightson Livestock Mobile Pace Information A16124 was lodged by Stipendiary Steward Mr S Renault alleging that Mrs K Barclay ( Love on the rocks) used her whip free of the rein shortly after the start.

Mrs Barclay was present at the hearing and confirmed she understood the Rule and admitted the breach.

EVIDENCE:

Mr Renault asked Mr McIntyre to highlight the start of the race on the various video clips showing Love on the rocks who started in barrier position 2 leaving the mobile barrier. Mr McIntyre pointed out Mrs Barclay giving the horse 1 strike with the whip shortly after the start with her action being free of the rein.

Rule 8692 reads as follows … No driver shall during any race use a whip in a manner in contravention of the use of the whip regulations made by The Board.

REASON FOR DECISION:

Mrs Barclay having admitted the charge it was found proved.

SUBMISSION FOR PENALTY:

Mr Renault stated that Mrs Barclay has had 233 drives this season and has had no breaches of this Rule in the reset calendar.

Mrs Barclay had no submissions on penalty.

REASON FOR PENALTY:

The Penalty Guidelines under this Rule for a first offence recommend a fine of $200. In this instance there are no mitigating or aggravating factors.

CONCLUSIONS:

Mrs Barclay was fined the sum of $200.
