EVIDENCE:

Subsequent to the running of Race 8 Information A15605 was filed with the Adjudicator.

It was alleged that Ms Fawcett permitted her mount “HUSK” to shift inwards when not sufficiently clear of “TWO MADISON” which was crowded for a distance then checked near the 1600m.

Ms Fawcett said that she understood the Rule, the Charge and confirmed that she did not admit the breach.

The Adjudicator advised Ms Fawcett of her rights in a defended hearing.

SUBMISSIONS:

Mr Oatham showed all film replays and in essence said that Ms Fawcett allowed her mount to shift in on “TWO MADISON” which was tightened and checked.  He said that Ms Fawcett and her mount was approximately ¾ length clear.  Racing on the outside of Ms Fawcett’s mount “HUSK” was “CHERRY LANE”.  Mr Oatham said that there was always a gap between the two runners and that you can actually see “HUSK’S” head turned inwards when interference occurred.

Ms Fawcett did not have any questions of Mr Oatham.

Mr Oatham called Mr Kamaruddin the Rider of “TWO MADISON” as a witness.

Mr Kamaruddin said that he was trying to find his spot when Ms Fawcett came in when ½ length clear.  He said that he called and then had to check.

Ms Fawcett asked Mr Kamaruddin whey did he look at Ms S Collett?

Mr Kamaruddin said because she was calling when he went in.

With the assistance of the films Ms Fawcett said that her horse’s head was not in all the way.  She said that she was in a tight spot herself and that Ms Newman put on a little pressure.  She said that she had nowhere to go.  She added that interference did happen, but that the outside horse had contributed.

REASON FOR DECISION:

The Committee found that Ms Fawcett did allow “HUSK” to shift in when not 2 lengths clear of “TWO MADISON” which was checked near the 1600m.

“CHERRY LANE” was racing outside of “HUSK” at the time, but at all times there appeared to be room for Ms Fawcett to stay off Mr Kamaruddin.

At the time of the check to “TWO MADISON” the film showed that the head of Ms Fawcett’s mount “HUSK” was turned in.  At no time did Ms Fawcett attempt to keep off Mr Kamaruddin’s mount “TWO MADISON”.

SUBMISSION FOR PENALTY:

Mr Oatham said that Ms Fawcett had had three breaches under the Rule in the last 12 months and considered the record to be a neutral factor.  He placed the carelessness to be low to mid-range.

Ms Fawcett said that she would like any suspension to start after racing on 16 October.

REASON FOR PENALTY:

Taking into account the degree of carelessness (low to mid-range) and the Penalty Guideline, it was determined by the Committee that a 6-Riding Day Suspension was a suitable penalty.

CONCLUSIONS:

Ms Fawcett’s Jockey’s Licence was suspended from the end of racing on 16 October through to all racing on 24 October 2021 (6-Riding Days).
