Evidence:

Stipendiary Steward Mrs L Selvakumaran filed Information No. A17878 alleging Licensed Trainer, Ms Gerard (on behalf of Moroney and Gerard Partnership) failed to declare a Rider for VERSAILLES (Race 8) by the required time.

The Information was endorsed indicating “I do admit the Breach of the Rule” and “I do not wish to be present at the hearing”.  Ms Gerard’s absence was approved by the Adjudicative Committee.

Rule 537 provides that:

The Trainer or Owner or lessee (as the case may be) or the Agent of the Trainer, Owner, or lessee (as the case may be) for a horse accepted or deemed to have been accepted for a Race shall:

(a) declare to NZTR the name of the Rider of that horse by the time and date specified by NZTR for declaration of Riders for that Race.

Mrs Selvakumaran advised the Adjudicative Committee that the Rider for VERSAILLES was not notified by the required time.

On race morning, Rider J Doyle was declared as the Rider for VERSAILLES.

By way of explanation, Mrs Selvakumaran was advised that a Rider was not declared by the required time, because there was a possibility that VERSAILLES would race at Ruakaka on Saturday (8 June 2024), but as it transpired, it raced at today’s meeting.

Decision:

The charge is admitted; therefore, it is deemed to be proved.

Submissions for Penalty:

Mrs Selvakumaran said that Rider declarations closed at 1pm on Monday 3 June 2024. She said that this is the Training Partnership’s third breach of the Rule and on that basis, an Information was filed, rather than having the matter dealt with by way of a Minor Infringement Notice.

Reasons for Penalty:

After consideration of the circumstances, including the admission of the breach, the Adjudicative Committee deemed that this matter can be dealt with by way of a fine.

Although this type of infringement would normally be dealt with by way of a Minor Infringement Notice ($50 first breach and $100 second breach), given that it is the Training Partnership’s 3rd breach and no reasonable explanation was offered for not declaring a Rider by the required time, an uplift is required.  Accordingly, a $150 fine is imposed.

Conclusion:

M Moroney and P Gerard Partnership was fined $150.
