Matamata RC 26 April 2024 – R2 – Dylan Mcdonagh

Background:

Following the running of Race 2, the ‘Mangakino RSA 2000’, an Information was lodged alleging a breach of Rule 638(3)(f)(ii).

Details are as follows:

‘used the whip with an action that raised his arm above shoulder height’

Mr Mcdonagh confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.

Rule 638(3)(f)(i) provides

(f) … in a Flat Race or Jumping Race…  a Rider must not use his or her whip:

(ii) using an action that raises the Rider’s arm above shoulder height;

Evidence:

Using available film, Stewards identified the incident. Charred was last in running and under some pressure . At the 400 metre mark, the Respondent is seen to strike his mount from above the shoulder. This is repeated at the 200 metre mark, with a third ‘marginal’ strike noted at the 100 metre mark. The Respondent confirmed that he agreed with Stewards’ interpretation and acknowledged it was ‘not a good look’.

Decision:

As the Respondent acknowledged the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Stewards referred to the current NZTR Penalty Guide, where a fine of $250 is recommended as a starting point. It was noted that the Respondent had received a warning for this breach type at Woodville on 12th April 2024.

Reasons for Penalty:

The breach is clearly identified by available film. After consideration of all pertinent matters, a fine of $250 was deemed the appropriate sanction.

Conclusion:

Jockey Mr Dylan Mcdonagh is fined a sum of $250.
