Background:
Following the running of Race 1, the ‘Lest We Forget 2000’, an Information was lodged alleging a breach of Rule 638(3)(g)(i).
Details of the breach are as follows:
‘struck his mount ‘Rum Night’ eight times prior to the 100 metre mark’.
The hearing took place after Race 2. Given work commitments, Mr Harris sought to be excused from attending the hearing. Given circumstances ie: breach type and admission, this request was granted. The Information was signed as admitted by the Respondent.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) except as provided for in (iii)(A) of this sub rule, strike a horse more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);
Evidence:
Using available film, Stewards identified the incident. From the top of the straight, to just prior to the 100 metre mark, Mr Harris is seen to strike his mount on eight occasions. It was also noted that the horse was struck a 9th time just inside the 100 metre. The horse was not struck in the last 50 metres. The Respondent’s mount won the event.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Stewards advised of a clear record as it relates to any breach by the Respondent of this Rule within the last six months. The Adjudicative Committee was referred to the current Penalty Guide, where the starting point for Penalty relating to 3 additional strikes, is set at a $500 fine.
Reasons for Penalty:
The breach is clearly identified by film. In setting penalty, it is acknowledged that the Respondent’s mount did win the race, however the horse was not struck over the concluding stages. After consideration of all matters, a $500 fine was deemed the appropriate sanction.
Conclusion:
Jockey Mr Troy Harris is fined a sum of $500.
