Background:

Following the running of Race 1, the ‘Lest We Forget 2000’, an Information was lodged alleging a breach of Rule 638(3)(f)(i).

Details of the breach are as follows:

‘struck his mount ‘Justice’ with the whip forward of the horse’s shoulder’

Mr Wiles confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.

Rule 638(3)(f)(i) provides that:  in a Flat Race or Jumping Race, a Rider must not use his or her whip forward of the Rider’s horse’s shoulder or the vicinity of its head.

Evidence:

Using available film, Stewards identified the incident. Mr Wiles is seen to strike his mount forward of the shoulder at the 200 metre and 125 metre mark. Mr Wiles confirmed that he agreed with the count.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Stewards advised of the Respondent’s clear record.  Stewards referred to the current Penalty Guide, where penalty for 1st breach of Rule 638(3)(f)(i) remains fact dependent. Precedent provides guidance where penalty has varied from a $250 to $500 fine, dependent upon individual circumstance.

Reasons for Penalty:

The breach is clearly identified by film. After consideration of all pertinent matters and referencing precedent, a fine of $300 was deemed an appropriate sanction.

Conclusion:

Jockey Mr Kylan Wiles is fined a sum of $300.
