Penalty: Apprentice Jockey, Bailey Rogerson suspended for 5 days

Evidence:

Following the running of Race 8, the “Noble and Lee Chartered Accountants 1400”, Ms Selvakumaran  presented an Information charging Apprentice Jockey, Miss B Rogerson with careless riding in breach of Rule 638(1)(d).

it was alleged when approaching the 150 metre point Miss Rogerson permitted her mount FREEWHEELIN to shift outwards when insufficiently clear of JOLTED (R Elliot) which was forced outwards into the line of the THEODEN (Ms B Grylls) which had to be checked.

The Race films depicted FREEWHEELIN moving off its permitted line when several horses were strongly mounting challenges inside the last 200 metres.  In moving outwards the mount of Mr Elliot was inconvenienced, contacted and pushed outwards.  This resulted in JOLTED being pushed into the path of THEODEN, requiring Ms Grylls to severely check this horse.  Miss Rogerson corrected the moment of her movement of her mount so as to move back inwards, but not before the interference had been caused to the outside horses.

On behalf of Miss Rogerson, Mr. Harris said that with Apprentice Riders it is sometimes difficult to maintain a straight line at that stage of the race and Miss Rogerson had only momentarily lapsed and corrected her mount quickly.

Decision:

As Miss Rogerson has admitted the charge was found proved.

Submissions for Penalty:

Ms Selvakumaran advised that Miss Rogerson had had 352 rides over the past 12 months with 2 breaches of the Rule (in January and March 2023).

Mr Harris sought a lenient penalty as the breach was at the lower end (the Informant had said in the lower/medium range), Miss Rogerson was a capable and promising Apprentice, with a good record.  She has riding commitments up until 1 January 2024.

Reasons for Penalty:

The Adjudicative Committee was satisfied that the degree of carelessness was, despite a breach of the Rule, low.  From a starting point of a 5 day suspension an allowance to reflect mitigating factors, including 11 months having passed since the March 2023 breach, a one day discount was applied.

Conclusion:

Accordingly, Miss Rogerson’s Licence to ride is suspended for 5 national riding days to commence at the conclusion of racing on 1 January 2024 and to end at the conclusion of racing on 6 January 2024.
