SUMMARY OF FACTS:
The Information alleged that N Parmar used his whip 6 times prior to the 100 metres when riding ‘MIGHTY CONNOR’.
The hearing of the charge was held over from raceday. At the outset of the hearing Mr Parmar confirmed that he understood the Rule and admitted the breach. This was confirmed by Mr Richards.
Mr Williamson presented film of the Race. Mr Parmar is seen to strike his mount (MIGHTY CONNOR) on 6 occasions between the top of the Matamata straight and the 100 metre mark. In addition, a seventh strike was noted on or about the 100 metre mark. This did not form part of the breach.
MIGHTY CONNOR won the race. When asked, Mr Parmar did not offer comment. Mr Richard suggested that Mr Parmar was simply over eager.
REASON FOR DECISION:
Mr Parmar admitted the breach therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Mr Williamson presented Mr Parmar’s record in respect of excessive whip use. Noted was a breach of the same Rule on 18 December 2021 (Waikato Racing Club). On that occasion a fine of $300 was imposed – in the context of a first offence.
Mr Williamson referred to the current Penalty Guidelines where starting point for a second offence is a fine being the greater of $500 or 50% of the Jockey share of the stake. He asked that in setting penalty consideration be given to the status of the Respondent as an Apprentice Jockey.
REASON FOR PENALTY:
A breach of the Rule was admitted and demonstrated. It is noted that $500 exceeds 50% of the jockey share of stake. In setting penalty the Committee does recognise Mr Parmar’s status. However, given the short time lapse from the first offence, the force of a number of the strikes and question mark around a 7th strike the Committee deem a fine of $500 is appropriate.
CONCLUSION:
Mr Parmar is fined a sum of $500.
