FACTS
Following the running of Race 1 at the Manawatu Harness Club a protest was lodged seeking a disqualification brought under Rule 870 (5) .
The placings as first called by the judge were:
1st – Johnny Who
2nd – Ya Know
3rd – Mr Monty
4th – Thank You
Horse, THANK YOU (B Butcher) galloped in the final 150 metres and was lapped on by STORMS ACOMING called in 5th.
Driver, B Butcher elected not to contest the protest or attend the hearing.
The films clearly showed and confirmed the breach of the Rule.
REASON FOR DECISION
The galloping and lapping on were confirmed on the films.

The disqualification was confirmed and placings amended to be:
1st – Johnny Who
2nd -Ya Know
3rd – Mr Monty
4th – Storms Acoming
