BACKGROUND
Following Race 2 Mr Dooley filed an Information alleging that Mr Doody the Driver of “DREAM PROSPECT” used his whip with more than a wrist flicking motion.
EVIDENCE
Mr Dooley showed film replays and said that for 50m early in the run home Mr Doody used his whip with more than a wrist flicking motion.
Mr Doody agreed with the Applicant’s interpretation.
Mr Dooley placed the breach in the mid-range.
DECISION
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS
The record showed that Mr Doody had a clear record.
Mr Dooley said that the starting point for mid-range was a fine of $500 or 2-days suspension.
Mr Doody said that he preferred a suspension and that his next two driving days were 6 & 8 December 2022.
CONCLUSION
Mr Doody’s Driver’s Licence was suspended from the end of racing on 17 November up to and including 8 December 2022 (2-days).
