Outcome: Protest Upheld

Penalty: KYLE LOCK disqualified form 4th place

Mr Munro sought the disqualification in Race 1 of horse 10, KYLE LOCH, promoted to 4th as a result of an earlier protest as it galloped in excess of 50 metres in the final 200 metres.

Placings after the earlier protest were:

1st – 7 MAD JACK

2nd – 5 CAEN

3rd – 6  HARLEEN QUINZEL

4th – 10 KYLE LOCH

5th – 3 THE POWER BROKER

Miss Haley demonstrated on the videos that KYLE LOCH galloped for approximately 170 metres in the home straight.

The connections of KYLE LOCH did not contest the protest.

After viewing the videos, the Committee is satisfied that KYLE LOCH was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. KYLE LOCH was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.

As KYLE LOCH has gained an advantage over the field, it is appropriate that the horse be disqualified.

Amended placings are:

1st – 7 MAD JACK

2nd – 5 CAEN

3rd – 6 HARLEEN QUINZEL

4th – 3 THE POWER BROKER

Stakes and dividends are to be paid accordingly.
