BACKGROUND:

Following the running of Race 7, Alabar Southern Supremacy Stakes Final (Group 2), Junior Driver, Mark Hurrell, admitted a charge that, as the driver of WAG STAR in the race, he made contact with a track marker on the final bend.

Rule 869(7A)(a) provides that “Every driver who moves inward shall ensure that contact is not made with any track marker”.

EVIDENCE:

Stipendiary Steward, Rebecca Haley, showed a video replay of the final 300 metres of the race. WAG STAR, driven by the Respondent, was leading the field approaching the home turn. She showed that, shortly thereafter, it shifted inward and made contact with a track marker.

DECISION:

The charge was admitted and is therefore deemed proved.

SUBMISSIONS FOR PENALTY:

Stipendiary Steward, Rebecca Haley, submitted that the appropriate penalty for the breach, being a Group 2 race, is a fine of $100. She referred to the fines of that amount imposed recently imposed for breaches of the Rule in Group Races.

REASONS FOR PENALTY:

For consistency, the Adjudicative Committee decided on a fine of $100.

CONCLUSION:

Junior Driver, Mark Hurrell, is fined $100.
