Penalty: Junior Driver Daniel Anderson was fined the sum of $200

BACKGROUND

After the running of Race 1 Level One Restaurant and Bar Trot 2200m, Information A13861 was lodged by Stipendiary Steward  Mr Vinny Munro under Rule 858(1)(a) alleging that Mr Daniel Anderson (SUPERFASTSUPERSTAR) delayed the start of the race by breaching the tapes.

Mr Anderson who is a Junior Driver was present at the hearing and admitted the breach and confirmed he understood the Rule.

Mr Brent Barclay a Senior Driver, had been present with Mr Anderson throughout the initial briefing and viewing of the incident. Mr Barclay had to vacate the room to take his drive in the up and coming race. Mr Anderson was comfortable to proceed with the hearing.

The Rule 858(1) reads:- A driver must not

(a) Delay the start

Mr Munro asked Stipendiary Steward Miss Rebecca Haley to highlight the various clips of the incident.

Miss Haley stated that SUPERFASTSUPERSTAR drew barrier 4 and Mr Anderson has brought him up to the starting tape breaching it prior to it being released. She identified the horse moving into position and the subsequent breaking of the tape early.

Mr Anderson agreed with Miss Haley’s account stating that he had simply misjudged the start of the race.

DECISION

As the breach is admitted the charge is deemed proved.

PENALTY SUBMISSIONS

Mr Munro stated that Mr Anderson has 43 lifetime drives, 26 this season and 17 last season.

Mr Munro confirmed that this was Mr Anderson’s first time in the Adjudicative Committee hearing room.

Mr Munro said that the HRNZ Penalty Guide is a $200 fine for this breach.

Mr Anderson when questioned confirmed that he had driven the horse before and it was normally a very good beginner which he was obviously aware of.

REASONS FOR PENALTY

The video films were very conclusive showing SUPERFASTSUPERSTAR breaking the tapes prior to their release which had clearly delayed the start of the race.

CONCLUSION

The Adjudicative Committee fined Mr Anderson the sum of $200.
