Hawke’s Bay RI 6 June 2022 – R6 – Dean Parker

FACTS

Mr Parker admitted a breach of Rule 638(3)(h)(i) in that he used his whip 14 times on “TITTLETATTLE” prior to the 100m (10 is the limit).

Mr Parker advised that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Oatham showed film replays and identified Mr Parker using the whip 14 times from the 1400m until prior to the 100m.

Mr Parker said that his mount lost momentum at the fence near the 1400m and that he tried to get it going again.  He added his mount did pick up late in the Race.

DECISION

As the charge was admitted along with the film evidence the charge was found proved.

PENALTY SUBMISSIONS

Mr Oatham said that Mr Parker was warned on 10 April for his whip use.  He referred to the Penalty Guide and said that the breach occurred in a prestige jumping race.

Mr Parker did not add anything further.

REASONS FOR PENALTY

The Committee observed that the whip was only used between a number of strides and was not used with undue force. Having regard to the Penalty Guide it was determined that a 1-day suspension plus a fine of $75 was an appropriate penalty.  The fine being 50% of Mr Parker’s share of the prize money that his mount earned for finishing in 5^th placing.

PENALTY

Mr Parker’s Jockey’s Licence is suspended from end of racing on 6 June through to all Racing on 17 June 2022 and a $75 fine imposed.
