SUMMARY OF FACTS:
Following Race 5 two Information’s were filed with the Adjudicative Committee.
Information A18303 alleged that the fourth-placed horse PRINCE ENVY galloped in excess of 50m inside the final 200m.
Information A11157 alleged that the third-placed horse PALISADE galloped in excess of 50m inside the final 200m.
The Judge’s Placings were:
1st   HIGHVIEW ROCKN ROLL
2nd  ERROL D
3rd  PALISADE
4th  PRINCE ENVY
Mr Mulcay showed film replays and said that PRINCE ENVY broke at the 100m and failed to return to a trot.
Mr Beecroft agreed with the Stipendiary Steward.
Mr Mulcay said that PALISADE broke at the 70m and continued to gallop to the finish of the race.
Mr House agreed with the Steward’s observation.
REASONS FOR DECISION:
Film replays were very clear in showing that PRINCE ENVY had galloped for approximately 100m and that PALISADE had galloped for approximately 70m inside the final 200m of the event. As both horses had breached Rule 870(3) and the Breaking Horse Regulations they were disqualified.
Rule 870(3) provides:
That any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).
CONCLUSION
PRINCE ENVY and PALISADE were disqualified with the placings amended to read:
1st    HIGHVIEW ROCKN ROLL
2nd   ERROL D
3rd   FLYING SCOTSMAN
4th   KISSME QUICK
The Adjudicative Committee gave approval for dividends and prizemoney to be paid on the amended placings.
