BACKGROUND:
Following the running of Race 1, Placemakers Timaru Trot, Trainer Gavin Smith admitted a breach of Rule 865(2) in that, as the Trainer of THE BEAT, a runner in that race, he presented the horse for the race without the notified pacifiers.
Mr Smith admitted the breach and elected not to be present at the hearing of the Information.
EVIDENCE:
Mr Munro said that THE BEAT, trained by Mr Smith, had been presented in the assembly area without the pacifiers which had been notified.
DECISION:
The Respondent has admitted the breach which is therefore deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Munro said that a breach such as this is usually dealt with under the Minor Infringement Scheme  and attracts a fine of $100. However, this is the Respondent’s third breach in a short space of time and Stewards were seeking a fine greater than $100, he said.
The Respondent had previously been fined $100 on 18 April and, prior to that, $200 on 13 March, Mr Munro said.
REASONS FOR PENALTY:
This being Mr Smith’s third breach of the Rule, a fine greater than a minor infringement fine is appropriate.
CONCLUSION:
The Respondent Trainer Gavin Smith is fined $150.
