Penalty: Driver Peter Hunter was fined the sum of $200

Background:

After the conclusion of Race 6, the Commodore Airport Hotel Chch Mobile Pace, an Information A13866 was lodged by Stipendiary Steward Mr Vinny Munro alleging that the Respondent Mr Peter Hunter (EMERALD ABBEY), used his whip in a continuous manner throughout the run home.

Mr Hunter admitted the breach and did not wish to be present at the hearing.

Rule 869(2) Whip and Rein Regs reads: “No driver shall during any race use a whip in a manner in contravention of the use of the whip regulations made by the board.”

Evidence:

Mr Munro asked Stipendiary Steward Miss Haley to use the video clips of the alleged incident. She highlighted EMERALD ABBEY from the top of the home straight to the winning post where Mr Hunter has continuously used his whip throughout.

Decision:

As the breach is admitted, the charge is deemed proved.

Submissions on Penalty:

Mr Munro stated that Mr Hunter has had 2783 lifetime drives, 143 last season and 72 this season.

Mr Munro also stated that the HRNZ Penalty Guide recommends a fine of $200 for the offence. Mr Hunter had no previous breaches under this Rule.

Conclusion:

The video evidence was clear and concise highlighting Mr Hunter’s continuous whipping manner. The Adjudicative Committee deemed a fine of $200 was appropriate in this instance.
