Evidence

Prior to Race 1 today Mr Goodwin lodged an Information with the Adjudicative Committee alleging that Mr D Turner breached Rule 330(3)(c) in that he failed to make the carded weight for LA CAPITA (R2) and CHASE (R6).

Overweight breaches normally sit within the minor infringement scheme, and attract standard penalties however the Stewards placed Mr Turner’s breach today before the Adjudicative Committee due to one of the races carrying Listed status.

Mr Goodwin explained that Mr Turner called him earlier this morning to say that he could not get down to the required 54kg weight for his rides in Race 2 and Race 6. As a consequence replacement Riders were found. Mr Goindasamy now rides LA CAPITA and Mr Bradley rides CHASE. Mr Goodwin said both these Riders were very adequate replacements.

Decision

As Mr Turner admitted the breach the charge was deemed proved.

Submissions for Penalty

Mr Goodwin said Mr Turner had a clear record over the last 12 months for overweight breaches and would normally be fined the sum of $100 for a first breach under the MIN scheme. The Stewards however sought an uplift due to Race 6 being of Listed status.

Mr Turner said he had found it difficult to waste due to riding Monday at Woodville and yesterday at Riccarton. He has only just recovered from illness which had not helped. He also pointed out that Mr Bradley had ridden and won a race previously on CHASE, his mount in Race 6.

Reasons for Penalty

The Adjudicative Committee took into account Mr Turner’s clear record, his recent illness/period of isolation and the fact that suitable replacement Riders had been found for both horses. A modest uplift has been applied to reflect the Listed status of Race 6.

Penalty

Mr Turner is fined $150.
