SUMMARY OF FACTS:

Class A Jockey, Jason Laking, was charged following Race 6, Inglewood Stud Rating 65, that he used his whip on his mount, FASTMOSA, seven times prior to the 100 metres.

The Rule provides that a Rider must not strike a horse with a whip more than 5 times prior to the 100-metre mark.

SUBMISSIONS:

Ms Algar showed video replays of the final 300 metres of the race. She pointed out FASTMOSA, ridden by Mr Laking, behind runners and wide near  the rear of the field as the field turned into the home straight.

She alleged that Mr Laking had used his whip, from that point, on seven occasions prior to the 100 metres. The video replay confirmed this.

The Committee noted that FASTMOSA had gone on to win the race, but did not deem that any advantage had been gained so as to constitute an aggravating factor. The strikes were not unduly forceful and were spaced.

REASON FOR DECISION:

Mr Laking had admitted the charge which is found proved accordingly.

SUBMISSION FOR PENALTY:

Ms Algar told the Committee that Mr Laking has one previous breach of the Whip Rules on his record – on 6 November 2021 at Riccarton, using whip in consecutive strides, fined $200. The present breach is, therefore, a second breach for which the Penalty Guidelines suggest a fine of $500. She submitted that a $500 fine is the appropriate penalty for this breach.

REASON FOR PENALTY:

Mr Laking has struck his mount with the whip a clear seven times prior to the 100 metres. It is his second breach of the Whip Rules. For a second offence involving a breach of the Whip Rules prior to the 100 metres, the NZTR Revised Penalty Guidelines provide for a starting point of a $500 fine. There being no relevant aggravating or mitigating factors, a fine of $500 is the appropriate penalty.

CONCLUSIONS:

Class A Jockey, Jason Laking is fined the sum of $500.
