SUMMARY OF FACTS:

Following  Race 4, Gavelhouse.com Maiden, Jockey Racha Cuneen was charged with a breach of the Whip Rules in that, as the Rider of SKY OASIS in the race, he struck his mount six times prior to the 100 metres.

The Rule provides that a Rider must not strike a horse with a whip more than 5 times prior to the 100-metre mark.

SUBMISSIONS:

Ms Algar showed a head-on video replay of the final 300 metres of the race. She pointed out SKY OASIS, ridden by Mr Cunneen, racing handy near the lead and nearest the rail. She then showed Mr Cuneen, with the whip in his left hand, strike his mount six times prior to the 100 metres. The number of strikes was clear from the replay.

REASON FOR DECISION:

Mr Cuneen has admitted the breach which is found proved accordingly.

SUBMISSION FOR PENALTY:

Ms Algar said that Mr Cuneen has a clear record under the Rule and she sought a fine of $250 in terms of the Penalty Guidelines.

REASON FOR PENALTY:

Mr Cuneen has clearly struck his mount with the whip on six occasions prior to the 100 metres. The NZTR Revised Penalty Guidelines provide for a fine of $250 for a first offence starting point for a breach of the Whip Rule prior to the 100 metres.

There are no relevant aggravating or mitigating factors.

CONCLUSION:

Class A Jockey, Racha Cuneen, is fined the sum of $250.
