EVIDENCE:

After Race 8 Information A15950 was filed with the Adjudicator.  It was alleged that Ms Johnson used her whip in two consecutive strides over the concluding stages.

Ms Johnson’s mount “FERDINAND” won the race (Stake $6720).

Ms Johnson endorsed the Information that she admitted the breach and signed the Information stating that she did not wish to be present at the hearing.

Mr Jones showed the films and said that over the final stages Ms Johnson had struck her mount in two consecutive strides.

REASON FOR DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Jones said that Ms Johnson had one prior breach, that being on 18 September 2021 when a fine of $400 was imposed (5 consecutive strikes).

REASON FOR PENALTY:

The Penalty Guide provides for a $300 fine or 50% of the Rider’s share of the stake money received, whichever is the greater.  On this occasion the figure of $300 was greater.

CONCLUSIONS:

Ms D Johnson was fined $300.
