Mr Davidson alleged that Mr Toolooa in Race 8, rode carelessly in that he allowed his mount BLEAKHOUSE BURTIE to shift outwards throughout the run home, crowding and checking outside runners.

Ms Algar identified BLEAKHOUSE BURTIE on the videos and demonstrated that the horse lay outwards throughout the run home shifting wider on the track and near the 100 metres, dictated CEDDY SMITH into the line of ARCEUS.

Mr Davidson said although BLEAKHOUSE BURTIE was hanging and shifting outwards, Mr Toolooa kept riding the horse forward with the whip. He commented that Mr Toolooa was originally 3 or 4 wide, and he ended up 8 wide.

Mr Toolooa said his ride was hanging and he had tried to straighten it. He accepted he had kept urging the horse and had used the whip.

Decision

As Mr Toolooa has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which was clear, with no breaches of this Rule in the past 12 months. Mr Davidson said Mr Toolooa had been off the scene for a time and had had 63 rides the past 12 months. He described the breach as mid-range, taking into account the degree of interference.

Mr Toolooa stated he accepted Mr Davidson’s submissions and wished the suspension to start after racing at Riccarton on the 23rd. Mr Davidson had no objection to this.

Reasons for Penalty

Mr Toolooa has shifted ground outwards in the course of the home straight, crowding and inconveniencing several horses racing to his outside. ARCEUS received a bad check. He was not his length and another clear and was aware his mount was shifting ground. He has continued to urge his horse with the whip, knowing there were horses to his outside.

It is a mid-range breach and from a 7-day starting point, there is a one-day reduction for admission and Mr Toolooa’s good record.

Conclusion

Mr Toolooa is suspended from the conclusion of racing on Saturday 23 March until the conclusion of racing on Thursday 4 April, 6 national riding days.
