Penalty: Trainer Kevin Townley is fined $200

EVIDENCE:

Following the running of Race 11, Trainer Mr Kevin Townley admitted a breach of Rule 305(c) whereas he failed to notify as soon as practicable, his horse AIGUILLE had a knee treated since last racing.

Mr Townley stated he understood the charge, not the Rule, and confirmed he admitted the breach.

Mr Williams said 20 minutes before the start of Race 11, Mr Townley had informed Stipendiary Steward Matt Sole, that his horse AIGUILLE had a knee treated since it last raced. He said Stewards accept there is no malice in Mr Townley’s failure to notify, but the horse has finished second today and the betting public was denied that information.

Mr Townley said he now understands what was required of him, but said the Rule does not state a deadline of when the Stewards expect to receive this type of information. He said he had been honest admitting the treatment and was unaware he had done anything wrong.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said there are two recent similar breaches by Mr Taylor and Mr Nairn, who were both fined $200 and this would be appropriate for Mr Townley.

Mr Townley made no submissions on Penalty.

REASONS FOR PENALTY:

For consistency, the Adjudicative Committee considers a $200 fine as appropriate.

CONCLUSION:

Accordingly, Mr Townley is fined $200.
