Penalty: Jockey Doni Prastiyou is fined $300

Evidence:

Following the running of Race 3, the Respondent, Rider D Prastiyou admitted a charge filed pursuant to Rule 636(1)(d).  The Information alleged that as the Rider of WANDA LU he failed to ride out to the end of the race when there was a reasonable chance of running into a higher position (5th). 

Mr Prastiyou acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 636(1)(d) provides: the Rider of a horse in a Race must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Using the available race films, Stipendiary Steward, Mr C Simpson demonstrated the incident.  He said that over the concluding stages of the race, WANDA LU was racing in fourth place on the rails.  He pointed out that over the final 30 metres he pushed forward for a stride, then sat up, eased his mount and coasted to the finish line.  Mr Simpson said that WANDA LU finished in sixth place and had Mr Prastiyou ridden out fully to the finish there was a reasonable chance he would have finished in fifth place.

The margin between fifth and sixth was a neck.

In response, Mr Prastiyou said that the films clearly show the breach.  He added that his mount wasn’t responding to being struck with the whip and he resorted to a “hand and heels” ride over the final stages of the race.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Senior Stipendiary Steward Mr Jones submitted that Mr Prastiyou has a clear record under the Rule.  He said that Mr Prastiyou admitted the breach at the first available opportunity, and he suggested a fine commensurate with the RIB Penalty Guide, ($300), be imposed.

Mr Prastiyou offered no submissions as to penalty.

Reasons for Penalty:

The Penalty Guide provides for a $300 fine in circumstances where a Rider fails to ride out their mount to the end of the race (fifth place).  The films clearly demonstrate the breach and had Mr Prastiyou exercised greater vigor over the concluding stages, given the neck margin, it is more probable than not, that WANDA LU would have finished in fifth place.  The betting public were not affected by the breach, but the stake money difference between fifth ($750) and sixth ($450) place is $300.

Accordingly, after consideration of the above factors, a fine of $300 is imposed.

Conclusion:

Mr Prastiyou is fined $300.
