Evidence

Following the running of Race 9, the Respondent Ash Lawson-Carroll, Apprentice Rider, admitted a charge alleging excessive whip use prior to the 100 metres.

Doni Prastiyou, Jockey, assisted Mr Lawson-Carroll at the hearing.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Stipendiary Steward Mr Dooley demonstrated that the Respondent struck his mount 7 times from the straight entrance to the 100-metre mark.

In response, by way of explanation, the Respondent Mr Lawson-Carroll, said he had made a misjudgment as to where the 100m mark was.

Decision

As the Respondent Mr Lawson-Carroll admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions For Penalty

Mr Dooley produced the Respondent’s record which indicated a clear record.

Stewards assessed the breach as low and submitted a penalty commensurate with the NZTR Penalty Guide for excessive whip use with 2 additional strikes, be imposed as penalty.

The Respondent made no submissions on penalty.

Reasons For Penalty

The Penalty Guide starting point for a breach of this nature is set out in the Penalty Guide. For a 1st offence with 2 additional strikes, a $250 fine, mitigation inclusive, is prescribed.

The Adjudicative Committee determined that there were no aggravating factors to consider, therefore no uplift in penalty was warranted.

On that basis, the Respondent is fined $250.

Conclusion

The Respondent Mr Lawson-Carroll is fined $250.
