Penalty: Licensed Trainers Robert and Jenna Dunn are fined $200

Evidence:

Following the running of Race 2, the Woodlands Stud “We sell Winners” Handicap Trot, Mr Mulcay presented an Information charging the Respondents as Trainers of “MOUNTAIN MASS” with a breach of Rule 865(2) of failing to present the horse in the notifiable gear, namely that the horse was presented with sliding blinds that were not notified.

Mr John Dunn, representing the Respondents, admitted the charge.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Normally the Minor Infringement Penalty for a breach of this Rule is a fine of $100.

Mr Mulcay advised that these Licence Holders had very busy operations in both North and South Island and acknowledged that Mr R Dunn had recently had a health issue.  The Informant contended that a fine of $200 was sufficient.

Mr John Dunn accepted that outcome.

Reasons for Penalty:

The Adjudicative Committee agrees that a fine is appropriate on this occasion.

Conclusion:

Accordingly, the Respondents are fined $200.
