Penalty: Driver Steven Reid is suspended for 2 northern race days

Summary of Facts

Following the running of Race 2, the Respondent Driver Mr S Reid, admitted a charge pursuant to Rule 869(2), Whip and Rein Regulations.

The particulars of the charge were that Mr Reid used his whip with more than a flicking motion in the home run.

Mr Mulcay, using the available race films, demonstrated that over the concluding stages of the race, Mr Reid struck the horse WORKS FOR ME, at least four times in a non-compliant manner.

In response, Mr Reid agreed with the Stewards, interpretation of the breach and had nothing to add.

Decision

The charge is admitted and therefore proved.

Submissions for Penalty

Mr Mulcay advised that Mr Reid had a clear record under the Rule. He said the Stewards assessed the breach at a low level and submitted that the Penalty Guide provides for either a $300 fine or a two-day suspension.

Mr Reid said that given the option, he would prefer a suspension as opposed to a fine. He added that although he has limited driving opportunities, he has two horses, including WORKS FOR ME, who he intends starting and driving at the next two northern meetings. Notwithstanding that, he did not seek a deferment of any suspension.

Reasons for Decision

The Adjudicative Committee considered that any penalty had to be meaningful, taking into account Mr Reid’s limited driving. The Adjudicative Committee, after questioning Mr Reid, were satisfied that he would be driving two horses in the forthcoming weeks.

The Adjudicative Committee considered the breach to be of a low level and that in the circumstances, a suspension would be appropriate.

Conclusion

Mr Reid’s License to drive in races is suspended from 15 September 2023, until after the conclusion of racing on Thursday 28 September 2023. This encompasses two northern meetings and equates to a two-day suspension.
