Penalty: Training Partnership Cran and Chrissie Dalgety fined $100
BACKGROUND:
Chief Stipendiary Steward, Nigel McIntyre, has filed an Information against the Training Partnership of Cran and Chrissie Dalgety, Trainers of RAKANOTTA, a runner in Race 4 at today’s meeting, alleging that they failed to notify the date of last service of the mare.
The Respondents were represented at the hearing by Junior Driver, Carter Dalgety.
Mr Dalgety had endorsed the Information on behalf of the Respondents “I do admit a breach of the rule” and he indicated that he understood the Rule and the nature of the charge.
Rule 403 provides as follows:
(1) The horses mentioned in sub-rule (2) of this Rule are hereby:-
(a) prohibited from being trained upon any racecourse or training track owned or occupied by, or in any way under the jurisdiction of any Club;
(b) declared to be ineligible to be entered for or to start in any race.
(2) The horses that shall be subject to the disabilities of contained in sub-rule (1) of this Rule are the following:
(m) any mare or filly after day 120 of its pregnancy. A trainer shall notify Stipendiary Stewards in writing as soon as practical:
(i) the pregnancy of any mare or filly in his charge; and
(ii) the date of last service of such mare or filly.
EVIDENCE:
Chief Stipendiary Steward, Nigel McIntyre, said that it was notified on race morning that the mare, RAKANOTTA, trained by the Respondents, had returned a positive pregnancy test and would be racing in foal in Race 4 at today’s meeting. The Rule requires that the Respondents should have notified to Stewards the date on which the mare was last served, but they had omitted to do so.
Mr Dalgety said that the stable had simply overlooked the requirement to notify on this occasion.
DECISION:
The charge is admitted and is therefore deemed proved.
SUBMISSIONS FOR PENALTY:
Chief Stipendiary Steward, Nigel McIntyre, referred the Committee to the recent case of Matheson, in which the trainer received a fine of $100 for a similar breach.
REASONS FOR PENALTY:
The Committee noted the reference by Mr McIntyre to the fine of $100 imposed in the recent Matheson case. The Committee also noted that a similar fine was imposed in the 2018 case of Stapleton. On the basis of those two cases, the Committee determined that a fine of $100 was appropriate in this case.
CONCLUSION:
The Training Partnership of Cran and Chrissie Dalgety is fined $100.
