Gore HRC 20 February 2022 – R1 – Colin Lee

Evidence:

At the conclusion of Race 1 the Frisken Contracting Limited Mobile Pace, an Information was laid by Stipendiary Steward Mr V Munro alleging that Mr C Lee (HE’S SANTA’S EXCUSE) used his whip free of the rein entering the home straight.

Mr Lee stated he understood the Rule and that he admitted the breach.

Rule 869(2) reads: No Driver shall during any race use a whip in a manner in contravention of the use of the whip regulations made by the board.

Stipendiary Steward Miss Rebecca Haley utilised the video replay of the run home highlighting Mr Lee using his whip free of the rein.

Mr Lee was very frank about his use of the whip and that he was driving very infrequently and he had reverted back to old practice.

Decision:

As the breach was admitted it was deemed proved by the Adjudicative Committee.

Submissions for Penalty:

Mr Munro stated that Mr Lee had no previous breaches of this Rule.  He said that Mr Lee was a hobby Driver and had only had 241 lifetime drives, no drives last season and 3 drives this season.

Mr Munro submitted that this breach fell within the $200 fine as highlighted by the Penalty Guide.

Mr Lee simply stated he had made an error of judgement in this instance.

Reasons for Penalty:

The video evidence along with Mr Lee’s frank admission supported that a simple error of judgement has been made and that a penalty of $200 as outlined in the Penalty Guide is deemed appropriate.

Penalty:

Accordingly Mr Lee is fined the sum of $200.
