Evidence:
Following the running of Race 9, an Information was lodged by Stipendiary Steward Mr Neil Goodwin requesting a Ruling in relation to Rule 632(2) as to whether STIPULATOR gained an unfair advantage at the start.
Rule 632(2) states:
If, in the opinion of the Adjudicative Committee, any horse gained an unfair advantage by its barrier stall malfunctioning and opening, or being forced, by such horse, open prior to the starter effecting a start, such horse may be declared a non-starter.
Mr Goodwin showed the films of the start with STIPULATOR beginning from barrier 2. Evidence was also heard from Starter Mr Clement, and Rider Ms L Sutherland. STIPULATOR got away to a very fast start, jumping ahead of all other runners. Ms Sutherland said the quick start did not afford her any advantage, as it was never her intention to lead. Mr Clement and Mr Goodwin maintained that no gate malfunction occurred, but rather STIPULATOR had perfectly synchronized its movement with the Starter’s button activation.
Decision:
The Adjudicative Committee, after thorough consideration, concluded that STIPULATOR did not gain an unfair advantage as defined in Rule 632(2). Factors taken into account, were the brief nature of the gate’s opening, consistent testimony from both the Stewards and the Starter, Ms Sutherland stating that the quick start afforded her no advantage and the absence of clear evidence of a gate malfunction.
Therefore, STIPULATOR is deemed a legitimate starter in the race.
Conclusion:
The Adjudicative Committee declared Judge’s placings to stand, and dividends to be paid accordingly.
