Mr Renault alleged that in Race 10, Mr Walsh (SARASOTA SUNSET) used his whip with more than a wrist flicking motion in the run home.
Mr Renault identified that SARASOTA SUNSET was held up for a run early in the home straight. After activating gear, Mr Walsh used his whip with more than a wrist flicking motion. There was one significant flourish.
Mr Walsh accepted the Stewards’ analysis of the video.
Decision
As Mr Walsh has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Renault produced the Respondent’s record, which showed that Mr Walsh has had 3 drives this season and 18 the last. His record is clear with the 2-month reset and his last warning was on 28 December last. Mr Renault submitted the breach was low-range.
Mr Walsh said he preferred a suspension, rather than a fine and for it to start immediately.
Reasons for Penalty
The breach is low-range. Mr Walsh has used his whip in breach of the Whip Rule and the Whip and Rein Regulations in the home straight. There is a particularly concerning initial strike. The Penalty Guide provides a starting point of a fine of $300 or a 2-day suspension for a first such breach. A penalty at the starting point is appropriate.
