EVIDENCE:

Following the running of Race 9, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Mr Rahul Beeharry.

Mr Beeharry stated he understood the Charge, was conversant with the Rule and confirmed he admitted the breach.

Mr Oatham played the final straight video to show Mr Beeharry (LEGEND BEAST) challenging for the lead, three horses from the rail. He pointed to Mr Beeharry strike his horse 7 times before the 100m and then a further 5 times within the last 100m.

Mr Beeharry agreed with Mr Oatham’s count and chose not to make any comment.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said Mr Beeharry has a clear record under the Rule. He said although Mr Beeharry won the race, the Steward’s opinion was the breach had no bearing on the result.

Mr Beeharry made no submissions on penalty.

REASONS FOR PENALTY:

The Penalty Guidelines provide for a first breach of the Rule, with 2 additional strikes, a fine of $250.

The Stewards’ view, of Mr Beeharry breaching the Rule having no bearing on the result, is supported by the video replay. Mr Beeharry’s whip use was understandably exuberant, winning his 50th race, nevertheless plainly in breach of the Rule, but the Adjudicative Committee will not be departing from the Guidelines on this occasion.

CONCLUSION:

Class A Rider Mr Beeharry is fined $250.
