Evidence

Following the running of Race 4, the Respondent Ms J Allen, Apprentice Jockey, admitted a charge alleging excessive whip use prior to the 100 metres.

Apprentice Mentor Ms K Clapperton was present to assist.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Goodwin demonstrated that the Respondent struck her mount 9 times from the straight entrance to the 100-metre mark.

In response, by way of explanation, Ms Allen said she just didn’t count.

Decision

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Mr Jones produced Ms Allen’s record, which was completely clear of any charges. She has been riding since the end of April and has had 47 rides.

Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of February 2023).

Ms Allen advised that after talking to her employer, any suspension could begin immediately.

Reasons For Penalty

The Penalty Guide starting point for a breach of this nature, where there are 4 or more additional strikes, is a suspension of 5 National Days.

After considering the film evidence, the submissions and having due regard for the number and frequency of strikes; the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis, the Respondent is suspended for 5 days.

Conclusion

Ms Allen’s Licence to ride in races is suspended for 5 days from close of racing today, July 1st 2023, until close of racing on Saturday July 8th.
