EVIDENCE:
Following the running of Race 10, an Information was presented by Stipendiary Steward Mr Mark Davidson, alleging a breach of Rule 638(3)(g)(i) by Jockey Ms Jasmine Fawcett.
Ms Fawcett stated she was conversant with the Rule and understood the charge, and confirmed she admitted the breach.
Mr Davidson played the race video of the final 400m to identify Ms Fawcett riding TELLING TALES, who was the widest runner as the field entered the straight. He pointed to Ms Fawcett strike her horse 6 times, the last strike was two strides short of the 100m marker.
Ms Fawcett said she had many horses to her inside, which made it difficult to sight the marker.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson stated Ms Fawcett was warned on 9 March at Riccarton, and was suspended for 5 days in a Group 1 Race on the 18 March 2023. He said this breach, her third and one strike over, has the Penalty Guide suggesting a $500 fine as Penalty.
Ms Fawcett made no submissions on Penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide a $500 fine for a third breach with one additional strike. The Adjudicative Committee can see no reason to depart from the Guidelines in the circumstances of this case.
CONCLUSION:
Jockey Jasmine Fawcett is fined $500.
