EVIDENCE:
Following the running of Race 2, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(3)(b) by Driver Mr Matthew Williamson.
Mr Williamson stated he was conversant with the Rule, he understood the charge and confirmed he admitted the breach.
Rule 869(3)(b) provides:
Any driver in a race may not drive:
(b) Carelessly.
Mr Renault played the video as the field entered the back straight on the final lap of the race. He pointed to Mr Williamson being forced to a 4-wide position. He then showed PETRONELLI GEE (W House), take up the vacated position and at the same juncture, GINAS MAJESTY (I Cameron) shifting outwards from the pylons to be alongside Mr House.
Mr Renault said from this point, Mr Williamson has shifted inwards to force Mr House down the track, but there is nowhere for Mr House to go, and the result of the general tightening has ended by PETRONELLI GEE and JORDAN ANNE locking wheels, extinguishing both of their chances.
Mr Williamson added he believed it was only a slight misjudgment, which he tried to mitigate, but it was too late.
DECISION:
The Respondent, having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Renault stated Mr Williamson has driven 234 times this season and has a good record. He said the Stewards viewed this breach to be low level but there have been consequences, 2 horses put out of the race.
Mr Renault said he would leave it to the Adjudicative Committee to arrive at an appropriate penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 3-day suspension starting point for a first breach of the Rule.
Mr Williamson has made an error of judgement, but tried to pull out of his manoeuvre when he realised Mr Cameron had shifted off the pylons, however, 2 horses have been extinguished from the race which is an aggravating factor. Mr Williamson must be given credit for his record and admission and the Adjudicative Committee in view of all factors, finds a suspension of 3 days is the appropriate penalty in this case.
CONCLUSION:
Mr Williamson’s Licence to drive in races is suspended from the conclusion of racing on 10 April 2023, up to and including 16 April 2023.
