Outcome: Proved

Penalty: Jockey Cameron Lammas is suspended for 5 National Riding Days

BACKGROUND:

Following the running of Race 7, the “ISCL MAIDEN 1230”, Mr Jones presented an Information charging Mr Lammas, the Rider of “MARUSYA” with careless riding in breach of Rule 638(1)(d).

EVIDENCE:

Mr Stewart demonstrated from the race films that after entering the home straight, Mr Lammas angled his mount outwards to obtain a run and when not sufficiently clear of “AGHANIM” ridden by Mr R Elliot, forcing it outwards off it’s rightful line, so as to crowd “THE WOMAN KING” (Ms Newman) which had to be checked passing the 200 metre mark.

Mr Lammas said that “AGHANIM” tended to move away so as to make the incident appear worse.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Jones advised that Mr Lammas had a clear record and had only recommenced riding in the past few weeks.  He assessed the carelessness as being low range.

Mr Lammas advised that he had committed riding engagements up to Otaki Maori Racing Club meeting on 24 November 2022.  The Rule provides for a deferment of a suspension for up to 10 days, or less provided there are committed obligations.

REASONS FOR PENALTY:

The starting point for low range careless riding is 5 National Riding Days suspension.  There are no aggravating factors requiring any uplift.  A discount for admitting the charge is not applied automatically, as where there is no arguable defence to a charge – as here – admitting it is not on its own, “mitigation”.

CONCLUSION:

Mr Lammas’ licence to ride is suspended for 5 National Riding Days to commence at the conclusion of racing on 24 November 2022, and to end at the conclusion of racing on 1 December 2022.
