SUMMARY OF FACTS:

Kate Hercock struck her mount 6 times prior to the 100 metre mark.

EVIDENCE:

All available films were shown.

SUBMISSIONS:

Miss Hercock had little to add but did indicate it was bad judgement on her behalf.

REASON FOR DECISION:

As Stipendiary Steward Neil Goodwin pointed out this was Kate Hercock’s 3rd breach of the Rule, the last on 29th of May .

SUBMISSION FOR PENALTY:

A penalty of suspension was asked for as her record was not good especially when she resumed race riding.

REASON FOR PENALTY:

The Guidelines state a 5 day suspension be imposed for a 3rd breach. The last breach was on the 29th of May and up to today she had made a determined effort to improve her whip use.

CONCLUSIONS:

Miss Hercock asked for a period of deferment to allow her to ride at the first day of the Spring Carnival at Hastings. As it fell within the Guidelines it was agreed to.

A 5 day period of suspension was imposed, beginning after the completion of racing on Saturday 18th of September until completion of racing on Saturday the 25th of September 2021.
