Evidence:
Stipendiary Steward, Ms V Algar lodged an Information with the Adjudicative Committee alleging a breach of Rule 534(2)(b) in that Trainer, Buddy Lammas failed to scratch his horse, BELLE ADAIRE, by the required time of 7:30am.
Ms Algar said she was notified by Mr Pollitt from the National Racing Bureau that they were having issues getting hold of Mr Lammas who had double-nominated his horse for races 7 and 4 today at Woodville. At 7.40 Mr Lammas called the Buraeu and advised his horse would be scratched from Race 7.
Ms Algar said the late scratching did not affect any other runners, for while it was a full field there were no horses on the ballot. Mr Lammas has a clear record in regard to this Rule.
Mr Lammas explained he double-nominated BELLE ADAIRE because track conditions and field numbers would influence which Race he started her in. He failed to meet the scratching deadline because he was rushing around this morning, and was out on the track where he was delayed due to a fall.
Decision:
As Mr Lammas admitted the breach the Adjudicative Committee finds the breach proved.

No specific penalty submissions were put to the Adjudicative Committee.

The Penalty Guide provides two starting points for breaches of this Rule:
scratching after 7:30am – no horse denied a start – $200
scratching after 7:30am – horse denied a start – $350
It appears Mr Lammas simply got busy and missed the deadline by 10 minutes.
There were no aggravating factors to consider.
