EVIDENCE:

The Rule was read as Miss Matthews was unaware of the reasons and consequences of the Rule. It was her first appearance in front of the Stewards and time was taken to enlighten her on the procedure. It was pointed out to her that by removing one hand from the reins and waving could place herself and other Jockeys in a dangerous situation. The Adjudicative Committee was surprised that although she was a class E Jockey and had ridden 2 winners in her 24  race day rides, she had no knowledge or understanding of the Rule.

Stipendiary Steward K Coppins stated that although her winning margin was substantial, she gave her celebratory gesture a number of strides short of the post.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS ON PENALTY:

Stipendiary Steward K Coppins indicated a fine as per the Guidelines would be appropriate, but did state consideration could be given for admittance and her record.

Miss Matthews had nothing to add.

REASONS FOR PENALTY:

It was determined that because of her admittance of the breach, and this being the first time appearing in front of the Stewards coupled with it being the last jumping meeting of the season, a discount off the Guideline figure would be appropriate.

CONCLUSION:

Miss Matthews was fined $150.
