Penalty: Class A Rider Samantha Collett is suspended for 5 days

Evidence

Following the running of Race 8, the ITM/GIB Whangarei Cup, the Respondent Class A Rider Ms S Collett admitted a charge alleging excessive whip use prior to the 100 metres.

The Information alleged that Ms Collett struck her mount BOSCH 9 times prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Stipendiary Steward Mr Dooley identified BOSCH ridden by Ms Collett, racing in second place in the run up the home straight.  He demonstrated that Ms Collett struck her mount 9 times from the straight entrance to the 100-metre mark. This being 4 more strikes than permitted under the Rule.

Ms Collett agreed with the number of strikes and had nothing further to add.

Decision

As Ms Collett admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty

Mr Dooley advised that Ms Collett has recently returned to race riding in New Zealand, having spent the last few years living and riding in Queensland, Australia.  He said she has a clear record.

Mr Dooley submitted that the Penalty Guide provides for a 5-day suspension for a first offence involving 4 or more strikes.  He said that there were no reasons to depart from the Penalty Guide on this occasion.

Ms Collett sought a deferment to any proposed suspension, until after racing on 6 July 2025. She had nothing further to add with regards to penalty.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature is a 5-day suspension. There are no aggravating or mitigating factors to consider.  On that basis, Ms Collett is granted a deferment and a 5-day suspension is imposed.

Conclusion

Ms Collett’s Licence to ride in races is suspended for 5 days, commencing after racing on 6 July 2025 and concluding after racing on 17 July 2025.

Note: the meeting on 13 July 2025 was not included as it is a Jumps Riders only meeting.
