Penalty: Class B Jockey Kozzi Asano is fined $300

EVIDENCE:

At the conclusion of Race 2, the NZB Insurance Pearl Series Race, Mr Williamson presented an Information alleging that Mr Asano committed a breach of Rule 638(3)(b)(ii) in that he used the whip excessively prior to the 100 metres mark when riding the horse IMAREADY.  That horse finished first in the race.

The relevant provisions of Rule 638(3)(b)(ii) were read to Mr Asano.  They are:

“A Rider shall not: …. 

strike a horse with a whip …… to an extent that is excessive.”

SUBMISSIONS:

Mr Dooley illustrated from the race film that, prior to the 100 metres mark, when leading the race, Mr Asano struck his horse 7 times.  The Guidelines limit the number of strikes to 5 prior to the 100 metres mark, which is well known to Riders.

DECISION:

As Mr Asano admitted the charge it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Harris emphasised that Mr Asano is a promising Apprentice who has many rides and had no previous breaches of this Rule.

The Applicant confirmed that Mr Asano has a very good riding record over the past 12 months.

REASON FOR PENALTY:

There is no reason for the Committee to depart from the Penalty Guide of a starting point of a $300 fine.  Whilst many Apprentices may find that significant fines exact  a disproportionately severe penalty, Mr Asano earned a good riding fee (5% of  $12,156) and can well afford a fine of $300.

CONCLUSIONS:

Accordingly Mr Asano is fined $300.
