Wellington RC 28 June 2025 – R1 – Michael Roustoby

Evidence:

Following the running of Race 1, the “NORM BEVAN MEMORIAL MAIDEN STEEPLECHASE” and the subsequent disqualification of “SMUG”, Mr Goodwin presented an Information charging Mr Roustoby with a breach of Rule 638(1)(e) of incompetent riding.  It was alleged that he rode “SMUG” incompetently by taking the wrong course when leaving the infield to join the course proper.

Mr Roustoby admitted the charge.

The relevant facts are recorded in the Adjudicative Committee’s earlier Decision disqualifying “SMUG” from first place in the race.  In short, all Riders were instructed and the correct course explained to them pre race, as is required under the Rules.  He admitted that he made a mistake, appearing to forget the instructions and being influenced when he saw the earlier gap in the rail on the bend, but well before the required entry into the straight.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Roustoby has a good riding record and genuinely regretted his mistake and how Owners, Trainer and punters were harmed by it.  The NZTR Penalty Guide provides for a starting point of 4 weeks suspension.

Reasons for Penalty:

The Adjudicative Committee takes into account that Mr Roustoby has lost a winning Rider’s fee of $1,100, his genuine remorse and good record, to reduce the suspension by 1 week.

Conclusion:

Accordingly, Mr Roustoby’s Licence to ride is suspended for 3 weeks, to commence at the end of racing today, 28 June 2025, and to finish at the completion of racing on 19 July 2025.
