SUMMARY OF FACTS:

Ms C O’Beirne the Rider of “POLAR BLAST” (4th) admitted a breach of Rule 638(3)(g)(i) in that she used her whip 7 times prior to the 100m (5 is the limit).

Ms O’Beirne said that she understood the Rule, the charge and confirmed that she admitted the breach.

The film was shown by Mr Coppins who identified the 7 strikes before the 100m.

Ms O’Beirne and Ms Clapperton agreed with the number.

DECISION:

As the charge was admitted it was found proved.

PENALTY SUBMISSIONS:

Ms O’Beirne had a clear record.

Mr Jones referred to the Penalty Guide.

Ms Clapperton said that the long straight caught Ms O’Beirne out and asked that consideration be given to the excellent record.

REASONS FOR PENALTY:

The Penalty Guide has a starting point of $250 or 50% of a Rider’s share of the stake, whichever the greater.  Ms O’Beirne’s mount earned $750 for its fourth placing.

CONCLUSION:

Ms O’Beirne was fined $250.
