FACTS:

Jockey Shaun Fannin admitted a breach of the Whip Rule in that he used his whip excessively prior to the 100 metre mark.

The films of the incident were shown and the strikes counted. Both parties confirmed they breached the Guidelines.

Jockey S Fannin had nothing to add.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS ON PENALTY:

Stipendiary Steward L Selvakumaran, while confirming  it was Jockey S Fannin’s  first breach of the Rule and he had admitted the charge, she believed a monetary penalty should be imposed, as his mount had won the race.

She was aware of the Penalty Guidelines indicating a warning for the first offence. She asked for a fine of $250.

Jockey S Fannin had no comment, but was aware of the Guidelines.

REASONS FOR PENALTY:

Although the charge was admitted and the Guidelines indicated a warning for the first offence, it was felt appropriate a fine be imposed, because the mount went on to win. A discount from the asked for figure was accorded, reflecting Jockey S Fannin’s admittance of the breach and the fact it was the first Highweight race of the new season in the Central Districts.

CONCLUSION:

Shaun S Fannin was fined $150.
