Penalty: Amateur Rider Evan Taiaroa is fined $100

Evidence:

Following the running of Race 5, the ‘Treadwell Gordon Maiden 2200m’, an Information was lodged alleging a breach of Rule 638(3)(i).

Details of the alleged breach were;

‘took his hand off the rein and struck his mount Overagain in the drawn position’

The race was for Amateur Riders and as such, Rule 638(3)(i) applies. The Rule is as follows:

‘In Races for Amateur Riders only, the whip may not be used in the drawn position. It may only be used in a slapping motion down the shoulder with the whip hand remaining on the reins’.

The Rule was read to Mr Taiaroa. He conveyed that he understood the Rule and admitted the charge.

Using available film, Stewards identified Mr Taiaroa striking his mount (twice) with his hand removed from the reins. Mr Taiaroa agreed with count. He added that although his hand was removed, the strikes were still in a slapping motion.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Goodwin advised that in their view, the offence was at the lower end. It was conveyed that Mr Taiaroa had been advised (warning not issued)  in respect of his obligations, at Woodville on 25th June 2023.

Offences under Rule 638(3)(i) are not provided for within the NZTR Guide. The Adjudicative Committee was referred to that penalty imposed on 22 August 2023 Rotorua-BOP HC, relating to a breach of this Rule. In this instance, a fine was imposed ($100).

Reasons for Penalty:

The breach is identified and admitted. It is acknowledged that the strikes were ‘slapping’ in motion, nonetheless with hands removed from the reins, the offence is created. A fine consistent with that imposed at Rotorua was deemed appropriate.

Conclusion:

Amateur Rider Evan Taiaroa is fined $100.
