Evidence:
Following the running of Race 1, the Respondent Class A Rider Mr Kavish Chowdhoory admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). The Information alleged that he permitted his mount VELTON to shift inwards when not sufficiently clear of SHEZAHAPPYONE, which was checked near the 800 metres.
Mr Chowdhoory acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.
Using the available race films, Stipendiary Steward Mr Goodwin demonstrated the incident and identified the horses and Riders concerned.
Mr Goodwin said shortly after the start, in the back straight, Mr Chowdhoory was looking to get a run closer to the rail. He had several glances to his inside, but continued to move in. Mr Chowdhoory was clear of the Te Akau runner to his immediate inside, but was not sufficiently clear of Ms Lindsay on the fence, riding SHEZAHAPPYONE. Ms Lindsay yelled out to him, but she was forced to check her mount sharply, as a result of him coming across and denying her room.
In response, Mr Chowdhoory said while he was looking across to see if he was clear, his horse stepped in of its own accord.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions for Penalty:
Mr Goodwin produced Mr Chowdhoory’s riding record, which indicated 5 previous breaches under the Careless Riding Rule in the last 12 months, namely:
30/12/23 Kurow – 4 days
10/2/24 Riccarton – 5 days
13/4/24 Riccarton – 5 days
30/6/24 Otago – 4 days
15/9/24 Awapuni – 5 days
Mr Chowdhoory has had 331 mounts in the past 12 months.
Mr Goodwin said Stewards assessed the level of carelessness to be above mid-range.
Mr Chowdhoory had no submissions to make in regards to penalty.
Reasons for Penalty:
The Adjudicative Committee has determined that Mr Chowdhoory’s careless riding incident falls within the mid-range category, warranting a starting point of a 7-day suspension, as per the NZTR Penalty Guide (March 2024).
The video evidence clearly showed that Mr Chowdhoory moved inwards when only one horse-length clear of SHEZAHAPPYONE, falling short of the required two-length clearance. Ms Lindsay’s vigorous calling and the fact that she was checked for several strides, further emphasise the severity of the interference.
Mr Chowdhoory’s riding record is considered an aggravating factor. The Adjudicative Committee notes a concerning pattern of Mr Chowdhoory not exercising due care during races, which is essential for the safety of both horses and Riders.
Additionally, the Adjudicative Committee took into account that Mr Chowdhoory has already received a 7-day suspension for a separate careless riding charge in the same race.
Mr Chowdhoory’s Licence to ride in races is suspended for a period of 8 days, commencing after racing on Saturday December 7th 2024 and concluding after racing on December 19th 2024.
