Wanganui JC 15 July 2021 – R 1 – Timothy Johnson

EVIDENCE:

Following the running of Race 1, the NZB Insurance Pearls Series Race 2060 metres, Mr Goodwin presented an Information alleging that Mr Johnson breached Rule 638(3)(b)(ii) in that he struck his horse with a whip to the extent was excessive.

Mr Johnson admitted the charge.

The relevant Rule 869(b) provides that a Rider shall not strike a horse with a whip in manner which is

Mr Jones illustrated from the race film that from the 600 metre mark to the 100 metre mark Mr Johnson struck his mount SUPER SPIRIT, 12 times.

REASON FOR DECISION:

As Mr Johnson has admitted the charge it is found proved.

SUBMISSION FOR PENALTY:

The NZTR Guidelines provide that if the number of strikes is 10 or more a 6 day suspension is the starting point.  Mr Johnson received a 7 day suspension for a breach involving 10 strikes.

Mr Johnson’s only submission as to penalty was that he accepted a suspension should occur but did not have the means to meet any financial penalty.  He has no committed engagements over the next 7 days.

REASON FOR PENALTY:

As a Class D Rider his riding opportunities are limited so in fixing the length of a suspension – which is to be 8 riding days – the Committee has regard only to those 8 meetings where he would have had the opportunity to ride.

CONCLUSIONS:

Accordingly, Mr Johnson’s Licence is suspended from the close of racing today, 15 July 2021 until close of racing on 14 August 2021.
