Penalty: Apprentice Jockey Rihaan Goyaram is fined $250

INTRODUCTION:

Following the running of Race 8,  the Respondent, Class B Rider Rihaan Goyaram, admitted a charge alleging that he used his whip with an action which raised his arm above shoulder height.

Rule 638(3)(f)(ii) provides:

Without limiting the generality of subrule 638(3)(e), in a Flat Race or Jumping Race, a trial (including jump-outs and/or tests for certification purposes) a Rider must not use his or her whip:
(ii) using an action that raises the Rider’s arm above shoulder height;

 Mr C McNab was present to support Mr Goyaram.

EVIDENCE:

Chief Stipendiary Steward Mr Oatham demonstrated the breach using available race films.  He identified Mr Goyaram riding GOSPODIN. He said that Mr Goyaram used his whip on 4 occasions above his shoulder height in the straight, however, added that the strikes weren’t extravagant or aggressive.

Mr Goyaram offered no comment.

DECISION:

As the Respondent admitted the breach, the Adjudicative Committee finds the charge proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said that the Respondent had a clear record under this Rule and the starting point penalty for a first breach was a $250 fine.  The Adjudicative Committee questioned Mr Oatham, as to why the Stewards had not put forward the suggestion of an uplift, given the number of strikes. Mr Oatham said that consideration may be given to Mr Goyaram’s inexperience and the fact that his Apprentice status meant that he received less than a Senior Jockey, in terms of riding commissions.

Mr Goyaram had nothing to add.

REASONS FOR PENALTY:

The Penalty Guidelines provide for a starting point fine of $250 for breaches of Rule 638(3)(f)(ii).

The strikes were not forceful and the Adjudicative Committee gave consideration to an uplift, due to the number of strikes being four, however, on this occasion, given Mr Goyaram’s Rider status, determined that a penalty in line with the Guidelines was satisfactory.

CONCLUSION:

Having considered all factors, the Adjudicative Committee determined a penalty of $250 was appropriate.
