SUMMARY OF FACTS:

Following Race 5 (Cambridge Stud Northland Breeders Stakes) R Elliot was charged under Rule 638(3)(G)(i) with striking his mount MAGNETO more than 5 times prior to the 100m.  MAGNETO finished 5th.

EVIDENCE:

Ms Algar showed film replays and identified where Mr Elliot struck his mount 6 times prior to the 100m (5 is the limit).

Mr Elliot agreed that it was 6 strikes.

SUBMISSION FOR PENALTY:

Mr Elliot’s record showed two breaches of the Rule in the last 6 months, those being 15.05.21 – $300 fine and 07.08.21 – $500 fine.

Mr Jones outlined the revised Penalty Guide which showed a 5 day suspension plus a fine of 50% of any prizemoney won by the Jockey.  This penalty starting point is for a third breach of the Rule in the last 6 months.

Mr Elliot submitted that the fine be increased with the suspension reduced.

REASON FOR PENALTY:

The Penalty Guide was adopted as a starting point.  There were no mitigating features to consider however the Race was a Group 3 event with a stake of $80,000.

Mr Elliot’s mount earned $2000 with Mr Elliot’s 50% share being $50.

Due to the Race being Group 3, an uplift in the fine only was considered appropriate.

CONCLUSIONS:

Mr Elliot’s Jockey’s License was suspended from the end of racing on 5 September through to the end of racing on 15 September 2021 (5 riding days) and a $200 fine was imposed.

(Ashburton on 6 September was not included in the suspension as Declaration of Riders had closed).
